Terms of Use

These Terms are a binding agreement between you and Aniket Bedwal, operating as Mandali (“Mandali,” “we,” “us”). By creating a Mandali account or using the app or this website, you agree to these Terms and to our Privacy Policy.

Please read section 15. These Terms contain an arbitration agreement and a class action waiver. They change how disputes between you and Mandali are resolved: most disputes go to individual arbitration instead of court, and you give up the right to take part in a class action. You may opt out of arbitration within 30 days.
Zero tolerance for objectionable content and abusive behaviour. Mandali has no tolerance for objectionable content or for members who abuse other members. Content that violates the community standards below will be removed, and the member responsible will be suspended or permanently removed, within 24 hours of a valid report.

1. The service

Mandali is a community platform for convenience-store and related hospitality professionals. The current release includes a community feed and Spaces, a job board, direct messaging, a services directory, and an industry news feed. Other features described on our website are planned and are not yet available.

2. Accounts

Mandali is for adults 18 years of age or older in the United States. You must give accurate information, including your date of birth, and keep your phone number secure. You are responsible for activity under your account. One person, one account: do not create an account for someone else, impersonate anyone, or use a phone number you do not control. You may delete your account at any time in the app (Profile → Delete Account); deletion is immediate and permanent.

3. Community standards

You are responsible for what you post, send or upload — posts, comments, messages, reviews, job listings, applications and photos. You agree not to:

We may remove content or suspend accounts that break these rules, including through automated filtering and without a report. Report objectionable content with Report in the app; you may also Block a member, which removes them from your feed and stops them messaging you. For urgent safety issues email [email protected].

We review reports and act on valid ones within 24 hours. We may remove the content, warn the member, suspend the account or remove the member permanently. Threats, sexual content involving minors and credible harm result in immediate permanent removal and, where appropriate, a report to law enforcement. We are not obliged to review everything posted and do not guarantee we will catch everything. If you believe we removed something in error, email [email protected] and we will review it.

4. Jobs

Mandali is not an employer, an employment agency or a staffing agency. We host listings and applications. We are not a party to any hiring decision, employment relationship or agreement between a member who posts a job and a member who applies.

Directory listings are provided for convenience; verify vendors independently. Listing a provider is not an endorsement, recommendation or vetting, and any dealings you have with one are between you and them. Some entries are labelled as demo listings for product illustration. Provider ratings appear only where real reviews exist.

Reviews are the personal opinions of the members who write them, not statements by Mandali. Write only about your own first-hand experience. If you are a listed provider and want your listing corrected or removed, or believe a review about you is false, email [email protected] and we will respond within 5 business days.

6. Third-party content

The News section shows headlines and short excerpts from public industry feeds published by third parties. We do not write, own, endorse or verify that content, and articles remain the property of their publishers.

7. Price

Mandali is free to use. There are no purchases in the app and no subscription. If we introduce paid features later we will tell you clearly in advance and you will never be charged without agreeing first.

8. Availability and changes

Mandali is an early-stage product. We may add, change, suspend or remove features, and the service may be unavailable at times. We will try to give notice of significant changes but do not guarantee uninterrupted availability.

9. Intellectual property

You keep rights to your content and grant Mandali a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it in order to operate and improve the service. The licence ends when you delete the content or your account, except that posts and comments already part of a conversation remain visible with your name and details permanently removed, and except for copies retained in backups for up to 30 days. You confirm you have the right to post what you post. Mandali branding and the app remain our property.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, or that any content on it is accurate. We are not responsible for the conduct of any member, online or offline, or for any content any member posts.

11. Limitation of liability

To the fullest extent permitted by law, Mandali and its operator, founders, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from your use of the service — including any employment decision, hiring outcome, dealing with a service provider, or interaction with another member. Our total liability to you for all claims relating to the service will not exceed one hundred United States dollars (US$100). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

12. Indemnity

You agree to indemnify and hold Mandali harmless from any claim, demand, loss or expense, including reasonable legal fees, arising out of your use of the service, your content, your breach of these Terms, or your violation of any law or anyone else’s rights.

13. Suspension and termination

You may stop using Mandali and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if we discontinue the service. Sections 4, 9, 10, 11, 12, 14 and 15 survive termination.

14. Governing law and informal resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.

Before starting any formal proceeding, whether in arbitration or in court, you agree to contact us at [email protected] with a short description of the dispute and what you are asking for, and to give us 30 days to resolve it. We will do the same before bringing a claim against you.

Section 15 sets out how disputes are resolved. For any dispute that is not covered by section 15, or if section 15 is found not to apply, the state and federal courts located in Delaware have exclusive jurisdiction, and you and Mandali each consent to that jurisdiction. Nothing here removes any right you have under the mandatory consumer-protection law of the place you live.

15. Arbitration and class action waiver

This section affects your legal rights. It requires most disputes to be resolved by individual arbitration rather than in court, and it waives class actions and jury trials. You can opt out within 30 days and still use Mandali.
  1. Agreement to arbitrate. If the informal resolution step in section 14 does not settle the matter, you and Mandali agree that any dispute, claim or controversy arising out of or relating to these Terms, the app, this website or your use of Mandali, including its formation, breach, termination, enforceability or validity, will be resolved by final and binding individual arbitration, and not in court, except as set out below. This agreement to arbitrate is governed by the Federal Arbitration Act.
  2. How arbitration works. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, available at adr.org. It will be conducted by one arbitrator, by written submissions, telephone or video, or in the county where you live, at your choice, unless we both agree otherwise. The arbitrator may award the same individual relief a court could award and must follow these Terms. The award may be entered as a judgment in any court with jurisdiction.
  3. Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may ask any court for an injunction to stop unauthorised use or misuse of the service or infringement of intellectual property rights. Nothing here prevents you from reporting a matter to any government agency.
  4. No class actions. You and Mandali agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding. If this paragraph is found unenforceable for a particular claim or request for relief, that claim or request will be severed and heard in the Delaware courts under section 14, and everything else stays in arbitration.
  5. Jury trial waiver. If a claim proceeds in court rather than arbitration, you and Mandali each waive any right to a jury trial.
  6. Your right to opt out. You may opt out of this section by emailing [email protected] with the subject line “Arbitration opt-out” within 30 days of first accepting these Terms, giving your name and the phone number on your account. Opting out does not affect any other part of these Terms, and we will not treat you differently for opting out. If you opt out, disputes are resolved in the Delaware courts under section 14.
  7. Survival. This section survives the ending of your account and of these Terms.

16. Apple App Store terms

These apply to your use of the Mandali app obtained through the Apple App Store, and Apple requires that we include them.

  1. These Terms are between you and Mandali, not Apple. Apple is not a party to this agreement and is not responsible for the app or its content.
  2. Scope of licence. Your licence is a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Maintenance and support. Mandali is solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support services.
  4. Warranty. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are Mandali’s sole responsibility.
  5. Product claims. Mandali, not Apple, is responsible for addressing any claims relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property claims. If a third party claims the app infringes their intellectual property rights, Mandali, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

17. General

If any part of these Terms is unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, incorporation or sale of assets, including a transfer of the service to a corporate entity formed to operate it. These Terms together with the Privacy Policy are the whole agreement between us. We may update these Terms; if a change materially affects you we will notify you in the app before it takes effect, and continuing to use Mandali after that means you accept the updated Terms.
